Copyrighted yes.

There are 2 sides to the fence here. Whilst there are many people are
putting up sites for others to download, i.e. pirated software; there
are just as many trying to close them down.
Of course, there are people who are hot on the heels trying to track
down copyright owners to reclassify those software to publicly available
copyrighted "Freeware" status.
