You shouldn't of course, in order to not strain your relations with
Apple Computer. And you needn't, since it's already available at
numerous other sites.
My guess is that Apple Computer toook the easy way out here: since
they're a pretty big company, they must have evolved that bureocracy
which go along with big companies. So to let you post Apple stuff
they wanted to do it in a, to them, legally appropriate way. Which
was easy enough for stuff which still was licensed, but apparently
too much trouble with too little gain for too old stuff which no
longer is licensed. So Apple Computer just said "No" to your
request to also post DOS 3.3/etc stuff.
If my theory of the "least trouble" to Apple Computer is valid, that
would also mean Apple Computer will never bother getting after those
people who do post DOS 3.3-related and similar old stuff, simply
because that too would be too much trouble with too little gain.

Now, if Apple Computer says "No, you mustn't post DOS 3.3", then what
about all those old third-party software, many of which does contain
a bootable DOS 3.3 image? Having bootable DOS 3.3 floppies for
almost everything was quite common back then (in particular since
you usually couldn't use that disk space for anything else anyway),
and was accepted by Apple.
