I believe he is only expecting the same things he expects from the
Lost Classics or Treasure Chest projects.

Penman isn't trying to take anyone to court for illegally distributing
someone else's copyrighted work so "standing" doesn't apply.

All he is doing is simply pointing out that it MIGHT be illegal to
distribute Merlin at this point so it would be safest to wait until
the matter is cleared up.  He is, in fact, trying to do people a
favour by saving them from maybe unknowingly breaking the law and
possibly being prosecuted.  What is so wrong with that?
