What theory makes *this* acceptable under the copyright laws?

The usual defenses don't seem to apply.

Still copyrighted (and will be when we are all dead).
Its not software/abandonware.
The copyright holder is still in business.
Whole copies can't be fair use.
No evidence of permission from holder.
5 notices of copyright are dutifully reproduced: can't be an innocent
mistake.
