Again, not true or correct.  Example given again: DiversiTune. It 
has not been reclassified.  It is still classified by its author as
a commercial title.  Special permission was granted for its legal
distribution to me and Ground to make it available from our website and ftp
site in a ShrinkIt archive and Henrick (to include with Bernie, as
an emulator image. 

So there you have another - not reclassified - still commercial - yet
legal with distribution.  Many other special status options can also
apply to legal distribution.
