Of course the justice department is going to go after
the big fish with their limited resources, but the case
defines piracy as putting up copyrighted stuff on web
sites.  That's all these discussions are about, right?
The definition of piracy.

So all those emu ftp sites are pirate sites.  Whether
or not they will get prosecuted is another matter
entirely.  It is clearly piracy one way or the other.

As to how the government is supposed to know if there
was or was not an agreement, that's why even Apple's
own ftp site used to have licensing agreements and
sites like Treasure Chest have freeware declarations
from the companies along with the software.

Under the case cited, the law (as passed in 1997) is
"if there's no notice of agreement otherwise, assume
piracy first" which means that unless the written
document (electronic or printed) that releases the
software as freeware, shareware, or PD accompanies
that software on an ftp site, the ftp site is commiting
piracy if it has said software available for download.
