Yes, I believe it must (should) be locally defined. In the U.S. there is a whole
chapter of the copyright law which exempts
educational institutions from certain violations, IIRC.

My preference would be for exemption, rather than a "turley tax" :o)
Reformation of a violator tends to be easier
than repealing a tax, at least in the U.S. :o)
