Unless things have changed, Apple has always required that you get
their permission to distribute their system software.  ProDOS, GS/OS,
HyperCard IIgs are all classified as system software, not freeware, so
you need their permission to legally distribute it.

Last I heard, all you had to do was ask and they would give you
permission.  However, that was for disk distribution.  They were a
little more stingy about electronic (file transfer) distribution.

You'd have to check with Apple.  I'll get around to doing so some day.
By the way, most Apple users groups have obtained permission to
distribute Apple's system software which is a great way to get the
software you need on real disks.  Even a Mac users group should be
able to get you the IIgs system software at least.  ProDOS 8 they
could only give you on 3.5" disks.
