Well, ProDOS 8 and DOS 3.3 are _allowed_ to be distributed electronically.
HCGS is _not_. Believe me, I just spoke to Apple Software Licensing about it
two days ago... And the information they sent me (list of licensable software)
included the following:

HyperCard IIGS 1.1 (fees waived)
   HyperCard IIGS requires at least Apple IIGS System Software 5.0.4 which   
   should be licensed and distributed along with any products that include 
   HyperCard IIGS (to simplify things for the end-user). System Software is 
   licensed seperately from HyperCard IIGS. Including System Software version 
   5.0.4 (or later) with products that include HyperCard IIGS is not required, 
   but is highly recommended. Distribution of this licensed material must occur 
   on physical media (electronic distribution is explicitly prohibited).
Special agreement required

In response to Dr. Tom: The "special agreement required" is to distribute
HCGS _at all_, not to distribute it electronically (since, of course,
"electronic distribution is explicitly prohibited"). I pointed out to the
Apple Licensing person I talked to that Apple distributes it
electronically, and he responded that yes, there are many products which
are distributed electronically by Apple, but which are _not_ licensable
for electronic distribution. If you feel like taking the risk of Apple's
lawyers coming after you, that's just fine - I, on the other hand, will
refrain from making HCGS available electronically.

Unfortunately, ftp doesn't support that type of thing... I'd be more than
happy to add info files telling _where_ it can be obtained, but I can't
directly link there...

No, that's Herman Zimmerman, production designer for DS9 and Voyager... No
relation, though I met him at a convention once... :)
