If you read the notes that come with Defender, you'll find that the author had written that with the intention of making money with it, but he couldn't get a license or =any= kind of deal from the copyright holder, so he dumped it into the public domain in frustration. It was at the time beyond a doubt a clear copyright infringement; I imagine that he wasn't sued because the copyright holder could not demonstrate that he was making anything off of it. At least, I don't think he was sued.
The guy seemed to be really unhappy about it all.
I don't know how this impacts your above statement; just thought I'd throw it into the mix here.
