It certainly isn't shareware.  I'm not sure exactly what its legal
status is, but it is probably similar to the system software and
HyperCard IIgs, i.e. you need a license to distribute it.

It is available from Byte Works, for something like US$15.  I don't
think I've seen it on any Apple FTP sites, and it is not legal to
upload to any non-Apple ones.
