Is this legal?

I recently purchased a copy of Impossible Mission II for the IIgs
over the net. But, when it arrived it was DOA. The disk is recognized
as unformatted by the Finder.

So, here is my question:

Since I legally bought the 'rights' to this copy of the program. Could
I get a working copy of another persons Impossible Mission II disk?

If this seems to be plausible, is there anyone out there with Impossible
Mission II who could help me out?

If necessary, I could privately provide the e-mail address of the person
I bought IM2 from for 'verification' purposes.
