but ...if you look at wikipedia's Fair Use entry - 
http://en.wikipedia.org/wiki/Fair_use - it's certainly possible it could 
fall under fair use.

I can't see a take down for at least mentioning the program - whether 
you host a possible download of the program is something for you to decide.
