The Supreme Court and most cooks would disagree with you.  In the botanical
sense, the tomato is a fruit.  In the culinary sense, though, it gets used
more like a vegetable than a fruit (most dishes that use tomatoes are
savory, not sweet).  In the legal sense, the tomato was declared a vegetable
for tax purposes:
