Basically it comes down to whether the programmers followed the rules
or not when writing their programs.  More software was written and
tested on the ROM 01 then on the ROM 3 so if they didn't follow the
rules, it is likely that they won't run properly on a ROM 3.  There
were a lot of demos and such by the FTA and others that only work on
the ROM 01 for instance.

This problem also applies to different versions of the operating
system.  There are some programs that work under System 4 but won't
run properly under System 5 or 6.
