Which is why the threatened suit against DRI's GEM was bogus. All of the
above was true of GEM, which was in development concurrently with
Lisa/Mac. And Apple knew, and approved of it.
But the nature of the suit, and several others of the day, was not about
the code, it was about the "look and feel" of the interface.
You're right Michael, but... Apple knew what GEM looked like, and that
their use of the trashcan was independant. It still goes back to M$
needing help stopping the GEM train so Windows could get off the ground.
(Please excuse the mixed metaphors)

Apple sued HP at one point over having a (differently shaped) trashcan
icon on the desktop! (If you sit at your desk and think about discarding
something, a trashcan seems like one of the first things that would pop
into anyone's mind.)
