Not so grey. Pretty black-and-white, really. The prevailing thinking is that
Apple won't be too upset if you actually own an Apple II and are simply
trying to preserve your Apple II stuff. That strikes me as rather thin
reasoning, unless you are using a Mac-based emulator. I suspect that Apple
has excellent, valid reasons for keeping the ROM code copyrighted and
in-house, but I would also bet that Apple believes that it has better things
to do with its time and money than chase down people running old software
for fun.
I own II+, IIe, and GS, and I downloaded my ROM images.
