Retail value simply means sale to a consumer, rather than to a wholesaler or
other intermediary.  In the unlikely event that some zealous US Attorney
decided to prosecute, it would be established by expert testimony.

For example, certain items (used cars, eg) may no longer be produced, but
nevertheless have clearly defined retail and wholesale values on the used
market.  Same with out-of-print books.  If there is an out-of-print book
that you want, Amazon will find it for you, and sell it to you retail.  For

I do agree that the likelihood of prosecution is remote, just not
impossible.
