I very much doubt that all encompassing "land grab" would stand up in court.

Why?  Ok.  Let's say you LEARNED something from anything you read on Delphi. 
They could say, "Hey!  You profited from our copywrited material written by
someone else who used a fake email account hidden 12 servers deep and we can't
find him!  Give us our money you scum!"  Uh, huh...

Ok, think about this one.  You can't SUE Delphi for messages posted on message
boards that they don't control.  (See the Telecommunication Act of 1996.  Or
AOL vrs..  Name escapes me at the moment.)  Now, you take a bit of Delphi's
copyrighted blather and go and hurt yourself.  Who can you sue?  Not Delphi. 
So the judge will say, "Oh, so you want all of the protections and none of the
responsiblity?"

"Yes," says Delphi.

"Who do you think you are?" asks the judge, "A tobacco company??!?!?  Ha!  Case
dismissed!"  A little political jibe there, but you get the point.

There are PLENTY of websites that say "Copyright ... blah, blah, blah ... You
will be hunted down and skinned, alive ... blah, blah, blah ... We claim rights
in perpetuity (sp) ... blah, blah, blah ... everything you do is recorded ...
blah, blah, blah ... we own the cookies on your system and can come over and
examine them at any time ... blah, blah, blah ..."

Yeah.  Ok.  Right. Yawn.  Click.  

Let's get serious.  You have to have civil court legal muscle to do this. 
Contracts are CIVIL law.  If you've been wronged, it's up to you and your
resources to fight it out and a judge or jury decides.  How many people or
companies are actually doing this?  The money in damages just isn't there. 
Sure, you've been wronged; but hey, prove it!  You know "Got milk?" but are you
familar with "Got cash?"

Part 2, I saw a news report on CNN a year or so back that showed some
university is backing up websites for posterity across the WORLD!  Dreaded 404
error?  No longer!  Do they care about copyright?  Do they have hundreds of
college students checking this out on a 24 / 7 basis?  Ha! Ha! Ha!

Ok, I'm going  back to reading this really, really off topic thread.  Why?  It
amuses me to see all this aired in public!

PS to "Dr. Tom:" Courts don't appoint free lawyers for CIVIL actions.  You
think your taxes are high now.  Just think if we all got free lawyers for every
little thing!  Get busted by the feds or cops in order to get free, legal help.

PS to Both of You:  You better both have lots of money.  Remember what happened
in the case of ARC vs. ZIP?  The lawyers won.  Big!
