Are you referring to old games remade as new or just exactly duplicated and
resold?
You do have a point, though. But....I think that IF for example MAME Roms were
not available over the net, but sold as an inexpensive package with historical
notes..etc .that it would sell seeing how popular it has become.  I feel the same
could be done for out classic computer systems. At least they would be legal
copies.  But the first thing to try for is re-classification....the CD package is
just a secondary idea in case after we bug the companies enough they still say
no, then perhaps they can still make a little money off of these titles.
But a lot of these games are so old that there shouldn't be any reason NOT to re
classify them.  Or at least give some indication that it's ok to copy them.
