Yes, the software is a problem - even for Bernie. The code in ROM is
copyrighted by Apple and cannot be distributed alongside with Bernie.
Buying out the copyrights is a way to cure this. Bernie could then be
sold as a complete package, which would make it much more attractive
program for many users who don't have a real GS to pull their ROM images
from. Those users are now forced to go to sites like Asimov to download
copies of these images, and these practices are frowned upon by some of
the more conscientious members of our fine society.
This, however, is not THE point, but just one facet of the whole story.
