The 6502 was designed some time around 1976, if I recall correctly.
That means it's 17 years old; which may imply that the patent may have
lapsed.
If that is the case, anybody can make a 6502 or 6502-based chip.
(Actually, a nice 32-bit 386ish chip based on the 6502 may be a good
idea.....)
