Hi,

there are more and more US websites which are offering vintage apple
II (cracked) commercial softwares (.dsk or .nib files) without the
explicit permission of the copyright holders.

What are exactly the risks if somebody in the USA upload such cracked
softwares on a server?

Just out of curiosity.

Risks? If it is not currently being offered for sale by the creator/owner or
an authorized distributor, about as close to zero as you can get.

tell that to the guy in Mass that was offering GBBS on his site!!! He leaned just how nasty that the Software Publishers ASSoc. can get.
