IANAL, and I don't know if Appleworks 3.0 "require[s] the original media
or hardware" as "a condition of access." The exemption only applies to
the "circumvention of technological measures that control access." The
use must be "otherwise non-infringing."
The concept of "abandonware" has no legal status except in the sense
that a common carrier is unlikely to receive a request to remove an
infringing item if the item is indeed abandoned.
