When I wanted to start selling the Apple 1 replica's I wrote to Woz after Apple blew me off. He was quick to give the ok to using
the source code for the Apple 1 as it was created before Apple computers was started and he had already freely distributed the
schematics and source code at the home brew computer club. He then stated that Apple would have a problem with the Apple II code
because it was created after the company was started. So, he seemed pretty sure if anybody made a II clone and used II source code,
Apple would come after them.
