Apple knew what GEM looked like, and that their use of the trashcan was independant. It still goes back to M$ needing help stopping the GEM train so Windows could get off the ground. One interesting thing is that GEM/ViewMax is now in the public domain, and some have worked on restoring both the trashcan and the movable resizeable windows.

Apple sued HP at one point over having a (differently shaped) trashcan icon on the desktop!
