It's not that the law says the author has control of their rights. It's a
way to control the folks who feeel they are entitled to have what they
want irregardless of who says no.
Entitlement is a psychological term that describes certain people who
blithly take what isn't theirs without a notion that it isn't theirs to
take. The law needs to be precise to the nth degree for these people
because they'll find loopholes where there aren't any. Clinton's legal
maneuvering is a good example of entitlement in action. The court came up
with a definition of sex that failed to include cigars so he argued that
he didn't have sex with that woman by that definition. He acknowledged she
had sex but he didn't. What's the definition of "is". That kind of
thinking is what the law is trying to control. I don't think its allowing
the author to control his work.
