I think that statement really sums up the main part of the
disagreements going on here.  The rest of your post is basically just
support for that position.

You also started speculating on how to change the law again instead of
talking about what we have to deal with today.  :-)

You feel that copyrights are there only to protect the creators
ability to make money from their creation.  I, and others, don't give
a hoot about the money.  It is about ownership of a creation and the
ability to protect that ownership.

If I create something and I want to own it and be able to do what I
want with it without making any money, that is my right as provided by
our current copyright laws.  For instance, if I were to release my
e-mail client as freeware but only wanted it being made available from
three or four internet sites and nowhere else, there is no money
involved, the software is still copyrighted and I've restricted who
has a legal right to distribute it.  Because I'd be making no money
from it, does that mean my copyright is invalid and that anyone should
be able to distribute it?  The answer is definitely no so why should
older copyrighted software be viewed any differently?  It may not be
worth much now but it still legally belongs to someone else and only
the owner has the right to allow distribution of that software.
Distributing it without that owners permission is illegal according to
our current laws.
