He was not selling the software, he was making it available to the public
on his website.  No money was involved.

...suppose a retailer ran across a several hundred original boxed sets of 
some software...you could probably say that he could loose out on $2500
or more of sales...it's not likely but possible.

No, it's not a joke.  It's illegal, that's the point.  Most people probably
wouldn't consider it that serious, but it's still illegal.  Why do you have
so much difficulty with such a simple concept?
