Tell It Like It Is - Part 2

For what it's worth, I've never even used an Apple ][ computer
to access anything with any telcom program for any of my A2
Internet efforts. Not even to this day do I use such a method.
I only use a Mac for all of my A2 Internet access and efforts.
No PC's no Apple ]['s - just Mac's. I find them a most useful
extension tool for all my Apple ][ related Internet efforts.

There is the one single instant of the Pacman binary file on
an archive that I did upload to my old web site on wco.com.
That same archive was also uploaded to Ground by me.  I did
not realize that action was of any illegal nature and had it
removed promptly when told that it was of an illegal nature.
That incident was done in my own ignorance, I admitted it on
this newsgroup last year and made a public appoligy for having
done so.

I'll be happy to address and discuss any other titles that I
thought were legal to upload, that turned out not to be -
should you care to name them, for a civil discussion on this
newsgroup.

At no time from 1992 to date, have I ever uploaded any
commercial software to the Internet for public access - either
illegally or knowingly. The copies of the sector edited
software that I sent to (the then team member of 1WSW), Alex
Seigfried (aka Jesse Blue) were obtained by me in that state
from the same place, Al Switzer's home,  They were placed
their by Joe Kohn and Al told me that Joe gave them to him
from this new French group that did programs much like the FTA
did.  I drove 40 miles to Al Switzer's home at his own
suggestion to get a copy of the Demo from Brutal Deluxe,
because Al told me they had mentioned me and several other
members of 1WSW in a text scroll of the demo. I was excited
over that and wanted to see it.  Alex Seigfried ask me to send
him a copy because he had no access to download it from the
ftp sites it was on, several months later.  I had no knowledge
that it was sector edited and altered from the original
release, as I'd never bothered to get another ftp archive of
it - already having this one.  I mailed it to Alex Seigfried,
he inturn showed it to Brutal Deluxe and need I go on.  We all
know the rest of the horse crap that is presented from their
web site and from Richard Bennett's Turkey page about me.

Many peoole do not agree with my Vamp releases, many others
loved and enjoyed them. So, many people now thing I'm a lying
sucm-bag and lunatic that did all this evil pirating of the
Brutal Deluxe software; 3200 Convert, it's src. code and the
LemminGS program.  Well, I've got some more info to now relate
on that matter.  Nobody broke into my home when I was away for
the weekend - as I originally though - to use my acct. from my
old ISP (wco.com) to make the uploads to the ftp sites.  No,
indeed, Jerry Cole who was then a trusted member of the
USA2WUG - (I founded with the help and blessings of Steve
Wozniak last year), had my acct. password, which I gave him
trusting him with it - to update his web page on my web site.
He bought the software from Joe Kohn, used my acct. to upload
it to the ftp sites and then lied to everybody about it -
telling them I asked him to buy it for me so I could upload it
to the ftp sites from my old ISP acct. on wco.com. He also
told many people that he sent the software to me by mail. But,
to this day I never have received or asked for it. And, I
conclude he still has it too.

After I returned and discovered what had been done with the
uploads of the Brutal Deluxe software from my old wco.com
acct. I contacted my administrator to obtain logs of all
access to my acct. for that weekend period. The logs showed
that Jerry Cole accessed my acct. with the password from his
Fremont area residence via his ISP, uploaded to archives to my
private web site space and then uploaded them to another ftp
site in Northern California.

I promptly contacted Jerry Cole about this and he coldly
stated to me that he did it and there was nothing I could do
about it. He stated I would have my acct. revoked and it
served me right for not providing him with what he had
requested.

He's advised me in a telephone call (which I have audio tapes
of) that if I ever make this information public he'll come
over to my home and beat me to a pulp. To which I now say come
on over Mr. Cole, I'm armed, ready, waiting and prepared to
deal with you.  He's a friend of Joe kohn and a subscriber to
Shareware Solutions II also. After telling me in a telephone
conversation that he wanted me to give him an illegal copy of
ProSel, because he couldn't afford to buy it from Joe Kohn
thru the special Shareware Solutions II subscriber price
offered to him, I refused his request. He simply said that's
OK, I know what to do about it.  Again...I have the audio
tapes of this telephone conversation. As well as emails from
him to this effect.

And, if you think all this is fantasy I made up then think
again Mr Sheldon Simms III, because I have all the original
letters, emails, audio tapes and a mountain of evidence, in
detail that - I'll be happy to allow you or anybody else to
personally review to prove it to anybody who wants to visit me
at my home and review it all.

You want proof of it all, come to my home and I'll show it all
to you peacefully, in a sane, orderly manner and let you
listen to the tapes I recorded of Joe Kohn in a telephone
conversation I had with him - when he admitted to me that he
made the illegal copies of the beta Spectrum of mine and all
the rest in that private box I had at Al Switzer's home for
safe keeping and back ups only.  You can listen to the tape in
Joe Kohn's own voice, telling me how he passed them on to
others to upload, to destroy my credibility in the A2
community.  There were many others involved in all of this and
beleive me Mr. Sheldon Simms III, I can and will prove it to
you and anybody else that has the desire to really see the
original letters on these matters, wants to take the time to
call Earl Childers, President of Seven Hills Software and ask
him about it all. He knows all about it, in complete detail
also.

Those are the facts Mr Sheldon Simms III.  And, additionally
I've never had any connection with any of your software - nor
have I ever pirated any of your software in any fashion.  I
don't even know what your software is, what platform it's for
- nor any of the titles of your software.

So, you'd better get some REAL proof before you start
splattering anything more about me and my so-called piracy
antics, that so many people seem to believe (beyond a shadow
of a doubt) now.  So how do you like them Apples Mr Sheldon
Simms III?

I'm no nut case and I certainly would never post something of
this magnitude if I did not have conclusive evidence with
documents, tapes and original letters, email, etc. to back up
every single word I've just posted.

And, I'd certainly never make such comments about you or
anybody else - as you've posted about me - without some sort
of concrete documentation and valid evidence to make it stand
up solid in public. Your comments like so many others proves
to me just how ignorant you really are of the hard and real
facts on these issues you've presented in public about me.
Just as so many others have done for so long now.

I'm already taking legal action against Nathan Mates, Brutal
Deluxe, Joe Kohn, Richard Bennett, their associates and their
ISP's over all their abusive and endless rants, libel and
slander he's posted about me over the past years on this
newsgroup and on his web site. I'm not thrilled over the
concept of doing it with anybody else, but, believe me I will
if need be. And, I do mean anybody!

Now, if you or anybody else wants to discuss and address the
issues concerning the matters of Word Perfect GS and IIe, I'm
ready to discuss them in clear, sane detail. I made two
serious judgement errors with that program and deeply reget
it. I also have the original letters with the postmarked
envelopes from both Quality Software and Scott Gamon on that
matter to show anybody that wants to see them, that I did not
intentionally make the archives available with any illegal
intent. Both I and my current ISP Adm. investigated the
matters concerning the legal owners and the current status of
the programs. if you care to review the situations with either
myself and/or my grin.net administrator, you could then
clearly understand I did nothing intentionally of any illegal
nature with the Word Perfect GS or IIe version archives.

also.  So make an appointment if you want to pay me a friendly
and peaceful visit and I'll be only to happy to prove it all
to you in vivid and documented detail with all the original
evidence you could ever wish to review.

I've already openly admitted on this newgropup also that I did
have a crack cocaine addiction from 1989 to 1992 and sold
pirated software from my home in San Francisco to support that
drug addiction and habit.  I've not done such from 1992 to
date and I've admitted how completely insane and stupid such
actions were. I've also stated that I was not proud of having
done that.  I'm deeply ashamed of it. There is no need to
continue with the discussion of such past errors of blatant
stupidity. What's done is done. It's public knowledge, it's
history and can not be undone. I deeply regret ever having
been pulled into such activity. I do not do such any more and
Nathan's rants that I still do and his public mutterings,
implications and comments that I'm still a drug user, abuser
and addict are nothing but vicious lies, slander and libel,
based on his own ignorant speculation.  And the same goes with
the piracy issues.

Having saved every post about me he's made and having every
comment he's presented to the public from both his web sites
and the Usenet, I'd venture to say I have a very solid case to
take to court over all issues concerned. And, That's exactly
what I'm doing!

I'm not perfect. I've never claimed to be perfect and free
from errors.I make mistakes and probably will make many more
mistakes in the future, just like you and everybody else will
make mistakes and judgement errors. I don't try to control
anybody or anything. I'm not the sort of person that uses
other people to a harmful end in mind either. I'm not trying
to drive anybody from the A2 community, with threats or bully
tactics.  I'm trying to provide as much useful information and
as much help with furnishing advise, assistance and legal
archives to our A2 ftp sites as I possibly can find the time
to. That includes the legal transfer of the entire AOL A2
archive collections to Ground for free public access.

I've been holding all this back for a long time now just to be
nice to the people that have done all this against me, over
the years.  But, no more - let the truth be know and let
everybody know that the evidence is in my hands and available
for private view and presentation for anybody that wants to
take the time and trouble to come and check it out personally.

So there you have it in a lovely rambling outline everybody.
This A2 community has soured to the point that I really don't
think holding the facts back any more make any difference or
can do any more dammage than has already been done.

Now concerning all I've stated here with this post - show me
your proof and your facts to prove otherwise. Not gossip, not
third handed rumors, not speculation, not hearsay, not
opinion, not any of those will hold up in a court of law.  You
have to show evidence with proof and fact - beyond a
reasonable doubt  Show this iron clad evidence to prove what
everybody has been saying about me in public for all these
years to be of any truth. You can't! It simply does not exist.
You show me one speck of documented evidence that proves me to
be a liar with any of this and I'll swiftly exit the A2
community after you present such evidence. I have no
intentions of leaving it otherwise. And I'm never going to
allow anybody to bully me or harrass me in public or private
for that purpose either.

There's a multitude of additional facts and details I could
relate in this post. I see no reason to go into more details
at this point with any of it. If you want more details on
anything you can ask me by email and I'll be only to happy to
provide them.

It is more of a setting the record straight kind of post for
all to see with the message, "this is what happened, this is
how I reacted, this is where I screwed up, I am sorry that
this happened, I won't do it again and now either love me or
hate me but, put these issues to rest where they should be.

I think most readers of this post will read it and let it all
go in one ear and out the other, won't dwell on it any further
and it may actually nudge some of the readers to tell Mates,
Kohn, Bennett and their crew of hate-festering morons to just
drop it; Its history now. No more need be said. If any more is
said, it will be their flames, lies, rants, rags and stupid
comments on all the matters and issues.

Now I've run out of any more words to say on these matters and
issues.  But, I have an entire file cabinet full of valid
evidence, original documents, letters, emails and audio tapes,
should you ever care to come and check them out. They will
always be available for anybody to privately review in my
presents in a peaceful, protective and orderly fashion. Some
time in the future - after all the legal issues are settled
with it all, I'm going to put it all together into a book and
publish it.
