Provided he still owns AppleWorks 3.0 (e.g. it wasn't sold as part of a
complete computer system), AND he did not attempt to run more than one
copy at a time, then it could be argued that this is reasonable.
If that is the case, it should be possible to create your own disk
images from the original AppleWorks disks.

Strictly, downloading _any_ version is illegal, because the upload
itself is illegal (AppleWorks is not allowed to be distributed in this
manner).
I'd agree that downloading a newer version is worse than downloading one
you already own.
