You only got a right to be annoyed at your software being put on a
CD-ROM if your documentation and/or program say not to do so, IMHO.
When I realized that it was even theoretically possible for stuff I
write to wind up on CD, I started including in my docs the note that
any form of distribution of my software that involves paying more than
$5 requires my permission.
