copy prodos.sys,illegal?

will I abuse the copyright law if I spread disks with prodos.sys & basic.sys?
I'll spread a tool to transfer diss & files between apple & pc with game i/o
and I dunno if I could make the disk bootable,say,put prodos.sys on it.

on the other hand,I think that's ok to spread a bootable dos 3.3 disk,right?

still on the other hand,it's illegal if I spread a bootable MSDOS disk,right?

(I'll send the tool in diskimage form,and hope no trouble with sending the d00d
 abuse the copyright law is a big trouble)
