I certainly hope NOT!!! You must have misread somewhere. The case is a suit

AGAINST the CIA for violating various first ammendment rights that should
extend to computer data as well. This case is an attempt by Steve and the
EFF to attempt to set some precedents that will affect us for years to come
and that may actually HELP to secure that E-mail that you've mistakenly
believe was private. Otherwise, be careful what you wish for...you might get
it... (The first half of your post indicates that you really DON'T want this
case thrown out, if you're against the gov't.)
