It's not a "policy". It's International Copyright Law and subject to 
criminal prosecution.

Darius Cubbage at Jerry's  hosting service confirms what Bill M has said 
that the site is NOT down. The links are deliberately disabled and the email 
address on the site has been deliberately removed, likely by Jerry Cline 
himself.  So I just sent Jerry email and asked him why.

Assuming nothing bad has happened to him and he hasn't moved or changed his 
phone, you can do the same thing yourself and contact him and ask him 
permission to distribute or copy freely. The following email appears to be

A communications package for the Apple II is one of the few programs for the 
Apple II that has commercial value. Proterm is very good. Unless you get 
permission from the Copyright holder to offer his work (which must be 
considerable judging form the high quality of Proterm) you can't do so. 
Having said that, if he no longer wants to distribute Proterm perhaps you 
will get lucky and get your wish.

If you want to spend less money and you want to obtain an Apple II 
commuciations package just order Telecomm from Sheppy. It's only $2.00 a 
disk. I ordered a couple along with several other low-cost programs that 
Eric thankfully makes available online and his links aren't broken:
