Interesting example. I agree with your assessment of infringement, these
photos are both legal. However, if they were important in some way (say one
was used for the cover of Life magazine), it will go to court, and one will
lose. I'd bet on it. Certainly they'll have negatices proving they also
produced their own original, but it won't matter.
