DCMA Section 108 Paragraph 8 Sub-paragraph 4:
In addition, the DMCA provides that preservation copying, which had been
limited to instances where a copy of work has damaged, deteriorating, lost
or stolen and a replacement copy is not available at a fair price, may also
be preserved if the copy's format has become obsolete. "Obsolesence" occurs
if the machine necessary to read the work is no longer being manufactured or
cannot be acquired reasonably in the marketplace.
Apple 2 materials fall under the "Obsolesence" definition since the A2
system is no longer being manufactured. Since the library itself will be
virtual, the location of the library is actually distributed across the
homes of each individual user who accesses the site. Under that condition,
we're not allowed to leave our houses with a copy. ;-)
