Why not ask the copyright holder in advance whether or not he or she (or
"it") would like a royalty for each download?

Otherwise, even if a copyright holder *were* ready, willing and able to sell
copies of otherwise out-of-print software for a reasonable price, by the
time s/he/it became aware of the presence of the archive, any demand,
however modest, would have been fully supplied by the free downloads.

I really think that the swimming pool analogy is pretty close:  would a
person want someone to use their swimming pool without asking while they
were away for the summer?  Maybe they wouldn't mind, maybe they would.  But
the presumptiousness of anyone who would do so without asking is certainly
annoying.
