Well Henrik, the situation is a little different this time. From what I 
understand, a "copyright" or statement such as "distribution or reprint 
explicitly prohibited unless written permission is obtained from xxyyzz" was 
never sent with the ORIGINAL document. Public domain doesn't exclude anyone, 
and it sounds like this article was public domain at one time.

Unless Joe Kohn attempts to get a court order prohibiting the use of any of 
Joe Kohn's PUBLIC DOMAIN articles, commentaries etc etc, he may be SOL. Even 
if he was to try to get a court order he would need to cite specific documents 
that Tom couldn't use.

A blanket statement such as "tom cannot use or reprint anything that I have 
written" is NOT legally binding. Especially considering that Joe explicitly 
allows the rest of the general populous to use his material. This my friend is 
called discrimination. Tom has the right to reprint anything in the public 
domain, and the only way to prevent that is for Joe to remove the said items 
from the public domain.

It kind of sucks when the law that joe swears by is used against him, doesn't 
it?
