It is my impression that if the rights to the software were not purchased
or transferred to anyone else (or any company) at the time of the company
going under, then the copyright reverts back to the author of the software.
So, I don't think that the assumption that it is freeware/PD is appropriate.

There is a copyright FAQ floating around and it may have the answer to this
in it.
