Help! :< need to recover two files with Invalid path syntax/Sys Error $040

Hi All;

	I just found two files that give an Invalid path syntax/ System Error
$040.

	an AppleWorks IIGs file with a name of "12th.court.case"

	and a teach file with a name of "Davis Fund"

	Now I know that these are invalid file names and why, but how do I
recover these files, what do I need in software and where can I get
it?

	Tring to rename the files did not work, even tring to make a duplicate
did not work.

	Also, how were these files able to be named in this way, without the
system complaining?

	Is there a way of setting the system up so this can not happen?
