It's less of a problem with the Apple II because it's no longer being
manufactured by Apple, and many of the old Apple // developers are out of
business, and thus care little about the use of their product nowdays. On
the other hand, with the Macintosh, many of the developers of earlier
software are thriving, and old Mac titles can still be bought in software
stores (I saw the classic Star Wars the other day).
