It is a side effect of Apple's developer tools (Xcode). Apple makes it
easy to write an application that will work on 10.3.9 or later. They do
still support creating applications for 10.2.8 (or earlier versions of
10.3), as long as the developer installs an extra SDK, jumps through
some more hoops and avoids certain OS features (may require creating a
different executable for earlier Mac OS versions). I haven't had a close
enough look to be certain of the details.

Third-party tools such as CodeWarrior (or old versions of Xcode) can be
used to create applications for older versions of Mac OS X. The big
catch is Intel processor support (universal binary) - it can only be
done on recent versions of Xcode, which ties in the 10.3.9 minimum
without extra work.
