This first point, he simply made to make it clear that the shareware
versions are no longer supposed to exist anywhere.  However, he is
telling anyone with the shareware version that hasn't upgraded to the
commercial version, they are allowed to continue to use the shareware
version.

He owns the copyright and it is his right to allow this.  He could
have told them that they must destroy their copies of the shareware
version but he was nice and is letting them continue to use it.

Here he is just defending his copyright.  No one but Shareware
Solutions II is legally allowed to sell or distribute CheckWorks.  Not
the shareware or commercial version.

Where is the problem?
