Ok, I've been following this thread concerning the vacilating
discussions, rants
flames and some valid, sane and polite logic - over the
inclusion of two fully
quoted Usenet CSA2 posts from 1995 by John Kohn, (in which he
stated no
restrictions were placed on their use) in an article submitted
to me, which I
published titled - 'Net Thoughts' - in the August issue of
A2-2000, available for
all to review and continue commenting on (if they wish) from
the following URL:

Mr. Kohn called my ISP - two days ago demanding his
copyrighted material on my
web site be removed at once. My ISP called me and wanted to
discuss the demands
in a 3-way voice call with Joe Kohn, myself and the ISP as
moderator Mr. Kohn
refused - started to yell irately to my ISP and my ISP hung
up. End of
discussion with that matter. My ISP, I and several others I
know (that are
fairly well read on copyright issues, legal matters, and such
as this on the
Internet) - all conclude the article is in the public domain -
without
restrictions.
Thus, the article will remain in the August issue of A2-2000.
That's all I have
to say about its remaining at this time. If Mr. Kohn elects -
he certainly has
every right to take me to civil trial in a local court over
the matters of his
protest. If he does this and the court orders me to remove
it, I will remove it.
But, not without a court order instructiing me to do so.
As with The Mike Westerfield 'INTERVIEW' and product listing
of The ByteWorks, in
the FREE.Ads folder (also in the August issue), Mike
Westerfield retains all
copyrights to his statements in that interview and the content
of his product
list. He can instruct me to remove it from the August issue -
if he want to. I
would then remove it promptly.
My ISP, myself and many others, versed in the legal issues of
Usenet postings and
their legal use within an article so published, all conclude
it (the article) is
public domain as an article - if so stated by the publisher of
that article -
even if it is stated in public to be otherwise by the legal
author of any
non-commercial quoted content, within the article in question.
Issue remains; is the disputed article public domain or
copyrighted material of
Joe Kohn? I'm clearly stating to the public here and now as
the publisher of that
article - that I'm placing that article titled
'Net.Thoughts.txt' in the public
domain.
If Mr Joe Kohn wishes to challenge my release of the article
to public domain, he
can do so in a civil court of law in the local area we both
reside in and
certainly I'll be happy to abide by the courts ruling and
orders over the matter.
