I have a suggestion for you that might make it possible for you to
resolve this problem.

Get hold of every person (or company) that might be the legal
copyright owners and get them all to agree to release it as public
domain or shareware.  If all of the people who might own the rights
agree to release it in this way, I don't see any legal problems
popping up in the future.

With the possible exception of failing to contact the actual copyright
owner.  :)
