Actually, it looks like there is a grace period..
Once a domain name expires, there is a renewal grace period, during
which the domain name may still be renewed.
For .com, .net, .org, .info, .biz, .us, and .name, it is 40 days.
For .cn, there is no renewal grace period.
For .com, .net, .org, .info, .biz, and .us, there is a Redemption
Grace Period (RGP) after the renewal grace period. During this 30-day
RGP, domain name can be restored. Restore fee is higher than renewal
fee.

Not sure if it's really enforced, as it seems to be a proposal
according to the ICANN page (dated from 2002).
